LA PLATAFORMA POR LOS DERECHOS DE LAS PERSONAS SIN HOGAR Y COLECTIVOS VULNERABLES, RECHAZAN EL PROTOCOLO DE EMPADRONAMIENTO PARA ESTE COLECTIVO Y PRESENTA RECURSO POTESTATIVO DE REPOSICION. <\/strong><\/p>\n

La Plataforma POR LOS DERECHOS DE LAS PERSONAS SIN HOGAR Y COLECTIVOS VULNERABLES de San Fernando, ante la publicaci\u00f3n el pasado 22 de febrero en BOP del \u201cProtocolo para empadronamiento de personas sin domicilios en los Servicios Sociales Municipales del Ayuntamiento de San Fernando\u201d, quiere manifestar ante la Opini\u00f3n Publica lo siguiente:<\/p>\n

1\u00ba El protocolo para empadronamiento mencionado y elaborado por el Ayuntamiento de San Fernando, no ha sido consensuado con las Asociaciones que trabajamos con las Personas sin hogar, tal como se hab\u00eda manifestado ante opini\u00f3n p\u00fablica.<\/p>\n

2\u00ba Los requisitos para empadronamiento de Personas sin Hogar se encuentran regulados en la Resoluci\u00f3n de 17 de febrero de 2020, de la Presidencia del Instituto Nacional de Estad\u00edstica y de la Direcci\u00f3n General de Cooperaci\u00f3n Auton\u00f3mica y Local, y ninguna otra regulaci\u00f3n o normativa de menor rango, puede restringir los derechos que en dicha Resoluci\u00f3n se recogen.<\/p>\n

3\u00ba La Asociaci\u00f3n PERSONAS SIN HOGAR CON DERECHOS , y la ASOCIACI\u00d3N PRO-DERECHOS HUMANOS DE ANDALUCIA, han interpuesto sendos RECURSOS POTESTATIVOS DE REPOSICI\u00d3N contra el mencionado Protocolo, por entender que es contrario a Derecho al incurrir en causa de nulidad de pleno Derecho conforme los art\u00edculos 47.1 a), b) y e) de la Ley 39\/2015 de 1 de octubre, de Procedimiento Administrativo Com\u00fan de las Administraciones P\u00fablicas.<\/p>\n
